4. Merchant Account Terms

When you apply for or request merchant services through Karma Merchant Brokers:

  • You must provide accurate and complete information.
  • You authorize Karma Merchant Brokers to submit or help submit your information to payment processors, banks, underwriting partners, gateways, equipment providers, and related service providers.
  • Approval is subject to underwriting and approval by processing partners or financial institutions.
  • Specific processing terms, rates, fees, equipment terms, and obligations will be outlined in your merchant processing agreement or related service agreement.
  • You agree to comply with applicable payment card network rules, processor requirements, banking requirements, fraud prevention requirements, and security standards.

5. No Long-Term Merchant Services Requirement From Karma

Karma Merchant Brokers does not require long-term contracts for standard merchant services unless otherwise stated in a separate written agreement. You may discontinue services subject to outstanding balances, open obligations, processor requirements, equipment purchase, rental, lease, or return terms, third-party service agreements, or any signed merchant processing agreement. Equipment, software, websites, automation, CRM tools, or third-party platforms may have separate terms.

6. Pricing and Fees

Karma Merchant Brokers is committed to clear communication regarding pricing. Fees may vary based on business type, processing volume, risk profile, payment method, equipment needs, website needs, automation needs, CRM needs, marketing or support services, and third-party provider requirements. Applicable fees will be disclosed before activation or as part of the relevant agreement.

11. PCI Compliance

If you accept credit card payments, you are responsible for maintaining Payment Card Industry Data Security Standard (PCI DSS) compliance. Karma Merchant Brokers may provide tools, support, guidance, or referrals to help with PCI-related requirements, but ultimate responsibility for PCI compliance rests with your business and applicable processing relationship.

12. Website, CRM, AI, and Automation Services

Karma Merchant Brokers may provide or support websites, CRM tools, AI communication tools, automation workflows, missed-call recovery, appointment reminders, customer follow-up, review requests, customer reactivation, and related technology services. You understand that:

  • Technology tools may depend on third-party platforms
  • Service availability may vary
  • Automation requires accurate setup and customer information
  • AI tools may not always understand every request perfectly
  • You are responsible for reviewing and approving business-critical information, offers, pricing, and customer-facing content
  • Karma Merchant Brokers does not guarantee specific revenue, lead volume, appointment volume, review volume, or business results

13. Karma Loyalty Points and Keep It Local Programs

Karma Loyalty Points and Karma Keep It Local programs are designed to support customer retention, local business promotion, and repeat customer engagement. Participating businesses may be required to process through Karma Merchant Brokers, maintain active participation, honor advertised offers, maintain accurate business information, follow approved promotional rules, operate ethically and honestly, and communicate with Karma regarding setup, support, and changes.

Program features, availability, rules, benefits, and participation requirements may change over time. Karma Loyalty Points are loyalty points and are not cash unless specifically stated in an applicable written program rule.

14. SMS and Text Messaging Terms

Karma Merchant Brokers may use SMS/text messaging to communicate with individuals who opt in to receive messages from us.

SMS Messages May Include

  • Appointment reminders and confirmations
  • Follow-up messages and requested information
  • Service updates and account-related updates
  • Merchant services, website, CRM, AI automation, customer retention, review, and local marketing information
  • Karma Loyalty Points or Keep It Local program information
  • Sales opportunity or 1099 representative information
  • Promotional or marketing messages when consent has been provided

Message frequency may vary. Message and data rates may apply. Consent to receive SMS/text messages is not required as a condition of purchasing goods or services.

You may opt out at any time by replying STOP to any text message. After replying STOP, you may receive one final confirmation message confirming that you have been unsubscribed.

19. Limitation of Liability

To the maximum extent permitted by law, Karma Merchant Brokers shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of our website, communications, services, third-party platforms, or related business activities. Karma Merchant Brokers' total liability shall not exceed the fees paid directly to Karma Merchant Brokers by you during the six months preceding the claim.

Termination of one service may not automatically terminate third-party agreements, merchant processing agreements, equipment agreements, software subscriptions, or other related obligations.

22. Governing Law

These Terms of Service are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any disputes shall be handled in the appropriate courts of Missouri unless otherwise required by a separate written agreement.
